The new laws have an impact on anyone who is selling, buying or leasing a property with a pool. These changes have been introduced to further protect the safety of children under the age of five around backyard swimming pools.
Properties to be sold with a pool must have:
A certificate of compliance; or
A relevant occupation certificate and a certificate of registration; or
A certificate of non-compliance
Do I need to register my pool?
A pool is any excavation, structure or vessel that is capable of being filled with water to a depth greater than 30cm and that is solely or principally used or that is designed, manufactured or adapted for the purpose of swimming, wading or any other human aquatic activity and includes a spa pool but does not include a spa bath, bath tub, or anything within a bathroom.

From the 29th April 2016 if you are selling or leasing a residential property with a pool or spa you will need a private certifier to certify your pool and include a compliance certificate or Certificate of non Compliance in any contract for sale or lease.
How long does a Certificate of Compliance last? A Certificate of compliance is generally valid for 3 years.

An inspection normally takes around 15-30 minutes depending on the size and nature of the barrier. No matter how big or small the property is our inspector takes as much time as necessary to ensure your pool is safe and to discuss any non-compliances with you and how to fix them. Pool safety is our first priority. Same day Certificates are provided for your convenience for compliant swimming pools to allow for fast turn around.
How long does the Pool Certificate Inspection take?
Provided that safe access is available, an inspection can be performed at any prearranged time to expedite the Certification process.
Do I need to be at home when the inspection takes place?
A Notice will be sent to you as to what needs to be fixed along with any diagrams that are applicable. If our inspector deems that the pool poses a significant risk to public safety, we are required to notify the council immediately. From the date you received the report you have a period of six weeks to attend to the noncompliant items. A reinspection will need to be organised within 6 weeks of the original inspection date. If by the end of the six week period the noncompliant items have not been resolved then by law we must send a copy of the noncompliance notice to the council. What happens if the inspection fails and my pool doesn't comply?
For properties that are being sold, a Certificate of Non Compliance can be issued upon completion of the necessary inspection. This certificate can then be attached to the contract of sale which in some cases can transfer the responsibility to the purchaser to rectify safety issues to achieve compliance. A purchaser generally will have up to 90 days from settlement to make the swimming pool barrier compliant provided there is no significant risk to public safety. Notwithstanding the above and in the interests of safety, Superior Pool Certifications NSW always recommends that any necessary rectification works are undertaken as quickly as possible to maintain compliance.
